Landlord Tenant Law in Washington DC: Why DC Landlords Must Have a Licensed DC Real Estate Attorney

If you own rental property in Washington DC, you already know that DC is not like renting out a place anywhere else. The district has some of the most tenant friendly laws in the country, and the rules keep changing. A move that would be perfectly fine in Virginia or Maryland can land a DC landlord in front of a judge or wipe out months of rent which is why you must have a fabulous real estate attorney.  Here is what you need to know, and why having the right attorney matters so much.

The DC Rules That Trip Up Landlords

Investor estate planning attorney DC  We get calls monthly from landlords that are in trouble and they do not have a license.  Please know...You need a license before anything else. DC requires a Basic Business License and registration for rental housing. Without them, you generally cannot even file an eviction case. Many owners find this out at the worst possible moment. Don't let it happen to you.

Eviction requires a legal reason. DC is a just cause jurisdiction. You cannot simply decide not to renew a lease and ask a tenant to leave. The law spells out the specific grounds that allow an eviction, and the notice you serve has to match those grounds exactly.

The eviction rules just changed. The RENTAL Act of 2025, which took effect at the end of last year, reshaped the eviction process. One big change: the notice period for unpaid rent dropped from 30 days to 10. That helps landlords, but only if the notice, the timing, and the filing are done right. One small mistake and the case can be dismissed, sending you back to the start.

Self-help is off the table. Changing the locks, shutting off utilities, or moving a tenant's belongings out is illegal in DC, no matter how far behind the rent is.

Money rules are strict. Security deposits are capped at one month's rent, must be held in an interest-bearing account, and generally must be returned or accounted for within 45 days after the tenant moves out. Late fees are limited to 5 percent of the monthly rent.

Rent stabilization and TOPA. Many older buildings fall under rent stabilization unless you qualify for and properly claim an exemption. And if you plan to sell, the Tenant Opportunity to Purchase Act may give your tenants the right to buy first. The RENTAL Act added some exemptions, but the process is still full of deadlines and paperwork Estate Planning attorney Potomac MD DC TOPA.

These are reasons why one must have a good real estate attorney working together with them when considering owning and renting to a tenant in DC.

Why You Need an Attorney Who Knows DC

A general real estate lawyer, or one who mainly practices in the suburbs, may not know how DC Superior Court's Landlord and Tenant Branch really works day to day. DC law is its own world. The notices, the court procedures, the rental assistance rules, and the housing regulations are unique to the district, and they shift every time the Council acts.

An attorney who lives in this world can help you write a lease that actually holds up in DC, get your licensing and registration in order before problems start, and serve notices that will survive a challenge. When a tenant stops paying or breaks the lease, you want someone who can move quickly and correctly, not someone learning the rules on your dime.
