According to legal expert, there is now "no mandate" against selling communal terrace lands across all of India. To be sure, each State has its own laws and policies at the federal level. These State requirements must be followed by all developers and group housing organisations.

The terrace of the housing society cannot be sold or leased by a developer to a specific owner, owners of other properties in the society, or to anyone else, according to the UP Apartment Act 2010. The housing organisation as well as the developer do not have any plans to sell the terrace to anyone. According to the legislation, all open areas in a housing society are set aside for the common enjoyment of the society's members, who have the right to do so in accordance with the recorded decisions of the municipal corporation.
